Instruments of Delegation

Many Council decisions are made in formal Council meetings by way of resolution. However, Council is also able to delegate some of its powers, duties and functions to council officers. This delegation is formalised through a written Instrument of Delegation.

Delegations are an effective way to streamline decision making. This enables Council to concentrate on broader strategic issues rather than administrative and routine matters.

Section 11(8) of the Local Government Act 2020 (the Act) states that Council must keep a public register of delegations made under this section. The following Instruments of Delegation have been made by Council.

  • S5 - Council to Chief Executive Officer
  • S6 - Council to Council staff
  • Council to Services Delegated Committee
  • Council to Urban Planning Delegated Committee
  • S12 - MBS to Staff

Section 47(7) of the Act states that the Chief Executive Officer (CEO) must keep a register of delegations made under this section. The following Instruments of Delegation have been made by the CEO.

  • S7 - CEO delegation to Council staff
  • S13 - CEO to Council staff
  • S14 - CEO to Council staff (VicSmart)
  • CEO sub-delegations to Directors
  • CEO sub-delegation - Environment Protection Act
