The Local Government Act 2020 (the 2020 Act) requires the Chief Executive Officer and a nominated officer to lodge a biannual return with the Chief Executive Officer twice yearly (March and September). The matters contained in the biannual personal interests return are prescribed in the Local Government (Governance and Integrity) Regulations 2020. 

Penalties apply for false or incomplete Personal Interests Returns, and for failing to lodge within the legislated time frames.

Under the 2020 Act, the term ‘nominated officer’ means a member of Council staff who: 

  • Has a statutory or delegated power, duty or function; and
  • Is nominated by the Chief Executive Officer because of the nature of that power, duty or function.

The 2020 Act requires the Chief Executive Officer to prepare a summary of the personal interests information disclosed in the last personal interests return. The summary must be published on our website and be made available for inspection at the council office.

It is important to note that the 2020 Act specifically states the street address or number of the land that is a place of residence of any person is not to be included in the summary.
