Council recognises tree protection and canopy cover is an important issue to the community. In the 2017-27 Boroondara Community Plan, the community identified protecting and increasing canopy cover on private land as a priority.

Canopy trees on private land in the municipality are protected by Council’s Tree Protection Local Law 2016.

The Local Law provides for a maximum penalty of $2,000 per offence.

This maximum penalty is set by State Government legislation. Council cannot increase this penalty or issue fines for more than this amount unless it chooses to prosecute the matter in the Magistrates Court.

Council recognises the Local Law fine is inconsistent with community expectations. Council has repeatedly lobbied the State Government to amend the legislation to increase the fines, however the State Government has refused to act.
