You can read the Regulations on the Victorian Legislation website.If you breach these, we’ll issue an infringement notice (fine).There are different reasons you could receive a fine. Here are some:Failing to prominently display the necessary details on the building before and during construction.Failing to display a valid occupancy permit in a designated area inside the building.Not finishing the safety measures report within 28 days of the yearly date when the last report was finished.Failing to register your pool/spa with us on time.Not lodging a Certificate of pool and spa barrier compliance (Form 23) by the due date.Pay your building fineYou must pay your building fine by the due date on the notice. There may be additional costs and legal proceedings if it's not paid by the due date.BPay: use phone or internet banking to pay with your credit card, savings or cheque account. Use the Biller Code and Reference number on your infringement notice.Online: pay on our website using our Online payments tool. You’ll need the infringement number on your notice. Post to: City of Boroondara, Private Bag 1 Camberwell VIC 3124.We don’t accept postal delays as a reason for late payment.We don’t issue receipts for payments posted to us.Request a payment planYou can request to pay your fine in instalments.Request a payment planAppeal your building fineYou may appeal your building fine only if you satisfy one of the 5 reasons below and can provide proof to back up your claim.You must appeal within 21 days of the issue date on the penalty reminder notice. After this, the infringement notice will be referred to Fines Victoria to manage or referred to our legal team to commence legal proceedings.Under the Act, you can appeal once per fine.You can't appeal a fine if you've already paid it. Acceptable reasons to appeal a building fine Fine involves a mistake of identity You believe the decision to fine you involves a mistake of identity. You can request a review if you were incorrectly identified as the person who committed an offence (for example, you were issued the fine but you're not the property owner).You must provide evidence to support your claim. Exceptional circumstances You experienced a situation that was unavoidable or exceptional, such as being hospitalised. You can request a review if you can show that the offence happened because of circumstances that were out-of-the-ordinary, unavoidable or exceptional.You must provide a detailed explanation of the circumstances and evidence, including dates and times, such as:a hospital admission document if you were hospitalised without noticea police statement if you were involved in a police incidenttravel documents if you had to travel without notice. Special circumstances Special circumstances led to your fine, such as experiencing homelessness or family violence. These circumstances are very specific. You should only select the Special Circumstances ground if you committed the offence and:had a mental or intellectual disability, disorder, disease or illnesshad a serious addiction to drugs, alcohol or a volatile substancewere homelesswere a victim of family violenceexperience severe or disabling long-term circumstances or condition (even if you didn’t have it at the time of the offence) that prevent you from dealing with the fine.You will need to provide evidence from a qualified practitioner or agency to support your application. Unaware of infringement notice You did not know that the fine was mailed to you. You can appeal a building fine if you didn't know that it had been mailed to you.Note: if your postal address has changed and you failed to inform us of this within 14 days of it changing, you can’t appeal on this ground.Provide evidence showing you did not know about the fine. This could be:a copy of your passport or boarding pass showing you were overseasan invoice from a removalist showing that you moved housea VicRoads address change confirmationa report about your mail being stolen.If your application is successful, you’ll be granted a further 21 days to deal with your fine. The fine is contrary to law The fine was issued unlawfully or the officer who issued the fine acted outside their authority. You can request a review if you believe the decision to fine you was inconsistent with the law (for example, if the officer who issued the fine acted unlawfully, improperly or outside their authority or the fine does not comply with the legal requirements of an infringement notice).You must explain why you believe the fine is contrary to law. Expand all Collapse all What to includeWhen you submit your appeal, you must include:documents to support your appeal, including a detailed explanation of the circumstanceswritten authorisation from the fine recipient if you are appealing on their behalfthe infringement notice number.We’ll review your appeal and tell you within 90 days whether it has been successful. In the meantime:you won’t incur additional feesyou won’t need to pay any outstanding amounts.If your appeal is unsuccessful, you’ll need to pay your building fine and ensure any additional steps on the infringement notice are completed.Appeal a building fineChoose for a court to hear your appealYou can choose to have the Magistrates Court hear and decide on your building fine appeal. Please be aware that the penalty you receive from the court may be more severe than the building fine.If you previously asked us to review your fine and you later choose to have it heard and determined by a court, we'll cancel your internal review.Appeal a building fine through court
