Apply for an Out-of-Hours Works Permit if you need to work outside standard hours for building or construction purposes.

An Out-of-Hours Work Permit allows you to:

  • temporarily change the working hours set out in a Planning Permit
  • complete works outside standard hours, if you have a Building Permit.

Standard working hours, as set out in the Boroondara Local Law, are:

  • Monday to Friday from 7:00 am to 6:00 pm
  • Saturday from 9:00 am to 5:00 pm.

No works are permitted on Sundays and public holidays. See the Victorian Government website for public holiday dates.

This application is for temporary changes to working hours only. For permanent changes to working hours, you need to amend your Planning Permit.

Eligibility

We’ll consider applications where it isn’t reasonable or safe to carry out works during standard hours.

You don’t need a permit to work out of hours in your home, where a Building Permit is not required.

Prepare your documents

Gather the following documents for submission:

  • proposed notification letter to impacted residents and businesses
  • list of addresses for notification
  • notification letter to police, fire and ambulance, if their services may be impacted.

Depending on the location of the building site, you may also need to submit:

  • approval from the relevant owners corporation
  • a Memorandum of Authorisation or approval from impacted public authorities
  • a Swept Path Analysis
  • a Traffic Management Plan or Traffic Guidance Scheme.

If your works impact public transport operation, you'll need consent from the relevant authority or operator.

Contractors and site managers should apply for an Out-of-Hours Works Permit at least 10 business days before out-of-hours works begin.

We'll assess your application

Once you’ve submitted an application, we may request more information from you or refer your application to one of our specialists.

After we've assessed the impact of your works, we may ask you to notify more residents or businesses.

We'll notify you by email with our decision.

If more fees are due in addition to the application fee, we’ll send you an invoice.

Fees

You'll need to pay an application fee of $128 and a permit fee of $207 per day, upfront. If you require additional days and your application is approved, we will invoice you for the extra days needed.

Fees for works with special Planning Permit conditions

If your Planning Permit includes a Construction Managment Plan and you want to request an Out-of-Hours Works Permit, an $86 application fee applies for:

  • Hours of Construction, or
  • a Construction Management Plan.

This covers work outside the hours specified on a Planning Permit.
