Note: Council resolved the following resolutions be made publicly available after 22 August 2023.
10.1 NELP - Boroondara Tennis Centre Compensation Claim
That Council resolve to:
1. Retain its rights and reaffirm NELP’s obligations under the Land Acquisition and Compensation Act 1986 to receive a response to the compensation claim for the Boroondara Tennis Centre (BTC) located at 1/150 Bulleen Road, Balwyn North within three months of lodgement.
2. Write to the Major Roads Project Victoria (MRPV) CEO, Duncan Elliott, and the North East Link Program (NELP) Executive Program Director, Jim Waller, to:
a. remind these parties of their obligation to conform with the statutory requirements and timeframes contained within the Land Acquisition and Compensation Act 1986 including the need to respond to Council’s compensation claim within three months of lodgement, being 18 September 2023;
b. advise these parties of our expectation they will act, at all times, as a model litigant, including conforming with Victorian legislation.
3. Make this resolution public on 22 August 2023.
