About Amendment C321boro
Amendment C321boro is proposed to affect 10 Markham Avenue, Ashburton (known as the Markham Avenue public housing estate and also known as 2-18 Markham Avenue) by introducing the Markham Housing Estate Incorporated Document, November 2019 into the Boroondara Planning Scheme to control use and development of the land and to make the Minister for Planning the Responsible Authority for the site, instead of Council.
The proposal as described in the Incorporated Document consists of 178 dwellings, including “approximately 111 of the dwellings in the development… to be for public housing”, in five buildings ranging between 2-4 storeys.
The effect of the Incorporated Document is the policies and controls in the Boroondara Planning Scheme would no longer be binding on the land. Any redevelopment of the land would be bound only by the conditions set out in the Incorporated Document. No planning permits would be required. Any plans for endorsement arising from the conditions in the Incorporated Document are required to be prepared to the satisfaction of the Minister for Planning, not to Council’s satisfaction.
DHHS have requested the Minister exempt himself from the requirement to formally exhibit the amendment to the public, pursuant to section 20(4) of the Planning and Environment Act, 1987.
To ensure the views of the local community are considered, Council carried out its own consultation with residents in January 2020.
Following community consultation, Council officers prepared a report that considered the views of residents and assessed the merits of the proposed Incorporated Document. The report was considered by the Urban Planning Special Committee (UPSC) at its meeting on 17 February 2020.
A list of recommended modifications was adopted and has been sent to the Minister for Planning and the Department of Environment, Land, Water and Planning for their consideration.
We are awaiting advice from the Minister for Planning and DELWP in relation to their response to matters raised by Council and the local community.
