About C263 (Part 1)

The amendment introduced the Heritage Overlay on a permanent basis to 3 Wilson Street, Surrey Hills (HO743), 15 Victor Avenue, Kew (HO745) and 70 Riversdale Road, Hawthorn (HO744) and deleted the Heritage Overlay applying on an interim basis from 70 Riversdale Road, Hawthorn (HO664).  

Current status (July 2018) 

On 26 February 2018, Council resolved to adopt Amendment C263 (Part 1) and submit the amendment to the Minister for Planning for approval. A copy of the Council report and meeting minutes are available .

The amendment came into operation on 12 July 2018 when a Notice of the Approval was published in the Victorian Government Gazette.

About Amendment C263 (Part 2)

The amendment proposed to apply the Heritage Overlay to 12 Power Street, Balwyn on a permanent basis. 

Current status (July 2018)

On 18 June 2018, the Urban Planning Special Committee (UPSC) considered the independent Panel’s report and resolved to:

  • Receive and acknowledge the Panel’s report and recommendations in accordance with Section 27(1) of the Planning and Environment Act 1987.
  • Endorse the Panel’s recommendations to Amendment C263 (Part 2); and
  • Refer Amendment C263 (Part 2) to an Ordinary Meeting of Council to be abandoned in accordance with Section 28 of the Planning and Environment Act 1987.

At the Ordinary Meeting of Council on 23 July 2018, Council resolved to abandon Amendment C263 (Part 2). A copy of the Council report and meeting minutes are available . 

As a result, officers have lodged a request with the Minister for Planning to delete the interim Heritage Overlay which applies to 12 Power Street, Balwyn through Amendment C300.
