Amendment C243 Part 1 and 2 introduced the Heritage Overlay to 4 places of individual heritage significance.

Amendment C243 Part 1 came into operation on 12 October 2017.

Amendment C243 Part 2 came into operation on 25 January 2018.

As exhibited, Amendment C243 sought to apply a Heritage Overlay to:

Following exhibition, the amendment was split into two parts: 

  • Part 1 to relate to 51 Barkers Road, Kew, which received no submissions during exhibition. 
  • Part 2 to relate to 9 Auburn Grove, Hawthorn East, 68 and 123 Riversdale Road, Hawthorn and 14 Sevenoaks Street, Balwyn, which received supporting and objecting submissions during exhibition.

Amendment C243 Part 1

Amendment C243 Part 1, which relates to 51 Barkers Road, Kew, has been approved by the Minister for Planning and came into operation on 12 October 2017.

The approved amendment differs to the amendment adopted by Council in that the Schedule to the Heritage Overlay has been amended to apply external paint controls to the property. This change was made by the Department of Environment, Land, Water and Planning following Council’s lodgement of the adopted amendment for approval.

Amendment C243 Part 2

Amendment C243 Part 2 was adopted by Council on 23 October 2017. You can access a copy of the Council report here.

At this meeting, Council resolved to abandon the Heritage Overlay for 14 Sevenoaks Street, Balwyn North and proceed with the Heritage Overlays for 9 Auburn Grove, Hawthorn East, 68 Riversdale Road, Hawthorn and 123 Riversdale Road, Hawthorn.

Amendment C243 Part 2, as adopted by Council, has been approved by the Minister for Planning with a minor change to the wording of the tree control for 9 Auburn Grove, Hawthorn East. 

The amendment has been gazetted and came into operation on 25 January 2018.
