About Amendment C268

Council is proposing to correct a number of errors and anomalies in the Boroondara Planning Scheme, including:  mapping errors, redundant overlay provisions, land affected by multiple zones and land where the zone is inconsistent with its use or ownership.

A complete list of the proposed corrections included in Amendment C268 is provided below.

Current status (June 2018)

Following exhibition, the Urban Planning Special Committee (UPSC) resolved to split Amendment C268 into three parts as follows:

  • Part 1 - five corrections which received a total of seven submissions that were referred to a planning panel for consideration. Amendment C268 Part 1 has since been adopted by Council. This comprises the following subject sites:
    • 689 Burke Road, Camberwell
    • 3-5B Lion Street and 25 Simpson Place, Hawthorn
    • 12 Albert Street, Hawthorn East
    • 488 Tooronga Road, Hawthorn East
    • 909-911 Riversdale Road, Surrey Hills
  • Part 2 - one correction relating to 2 Princess Street, Kew which received a submission and has since been abandoned by Council.
  • Part 3 - the remaining 27 corrections which received no submissions and have since been adopted by Council.

Amendment C268 Part 1 - Amendment adopted

On 28 May 2018, Council considered the independent Panel’s report and resolved to:

  • Adopt Amendment C268 Part 1 to the Boroondara Planning Scheme, in accordance with Section 29(1) of the Planning and Environment Act 1987.
  • Submit Amendment C268 Part 1 to the Minister for Planning for approval in accordance with Section 31(1) of the Planning and Environment Act 1987.

In accordance with the resolution, Council submitted Amendment C268 Part 1 to the Minister for Planning for approval on 7 June 2018. Council is now awaiting the Minister’s decision.

Once the Minister for Planning has made a decision on Council’s request for approval, Council will notify all affected and adjoining property owners and occupiers, as well as submitters, of the Minister’s decision.

Amendment C268 Part 2 - Amendment abandoned

On 26 February 2018, Council resolved to abandon Amendment C268 Part 2. A copy of the Council report is available online.

As a result, the changes to planning controls relating to 2 Princess Street, Kew, proposed as part of Amendment C268 Part 2, will not be introduced into the Boroondara Planning Scheme.

Council has notified all submitters to the amendment as well as any affected and adjoining property owners and occupiers of its decision.

Amendment C268 Part 3 - Amendment adopted

Amendment C268 Part 3 has corrected a range of anomalies in the Boroondara Planning Scheme, including: mapping errors, redundant overlay provisions, land affected by multiple zones and land where the zone is inconsistent with its use or ownership.

Following adoption by Council on 26 February 2018 (a copy of the Council report is available online), the amendment has now been approved.

A complete list of the proposed corrections included in Amendment C268 Part 3 is provided below.

Current status (July 2018)

On 15 June 2018 the Department of Environment, Land, Water and Planning (DELWP), on behalf of the Minister for Planning, approved Amendment C268 Part 3 to the Boroondara Planning Scheme. The amendment and revised planning controls came into effect on 28 June 2018. 

The amendment has been approved subject to an additional zoning anomaly being included in the amendment. The additional change relates to the rezoning of a part of Reserve Road, Hawthorn (west of the intersection with Kooyongkoot Road) from the Public Park and Recreation Zone to the Neighbourhood Residential Zone Schedule 3.

Amendment C268 Part 3 includes corrections to 28 sites as follows:

Balwyn

  • Delete Design and Development Overlay (Schedule 16) from 1 Weston Street, Balwyn, to remove the land from Balwyn Neighbourhood Centre - Area 3.
  • Rezone part of 383-395 Whitehorse Road, Balwyn from General Residential Zone (Schedule 4) to Commercial 1 Zone and apply Parking Overlay (Schedule 1).

Balwyn North

  • Rezone part of 1 Agnes Avenue, Balwyn North from Commercial 1 Zone to Neighbourhood Residential Zone (Schedule 3).

Camberwell

  • Rezone part of 34 Avenue Road, Camberwell from Commercial 1 Zone to Public Park and Recreation Zone and delete Parking Overlay (Schedule 1).
  • Rezone part of 401-403 Camberwell Road, Camberwell from General Residential Zone (Schedule 4) to Commercial 1 Zone and apply Parking Overlay (Schedule 1).
  • Rezone the Council owned portion of 600-610 Camberwell Road, Camberwell from Commercial 1 Zone and General Residential Zone (Schedule 4) to Public Use Zone (Schedule 1 - Service &Utility) and delete Parking Overlay (Schedule 1).
  • Rezone 1095 Toorak Road, Camberwell to Commercial 1 Zone and apply Parking Overlay (Schedule 1).
  • Rezone part of 5 Sefton Place, Camberwell from the Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone part of 6-8 Sefton Place, Camberwell from the Neighbourhood Residential Zone (Schedule 3) t38o Public Park and Recreation Zone.

Canterbury

  • Rezone part of 190A-190B Canterbury Road, Canterbury from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone and delete Parking Overlay (Schedule 1).
  • Rezone part of 54 Chaucer Crescent, Canterbury from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone parts of 31 Matlock Street, Canterbury from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone part of 89 and 60A Warburton Road, Canterbury from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.

Deepdene

  • Rezone part of 4 Leonard Street, Deepdene from Commercial 1 Zone to General Residential Zone (Schedule 4) and delete Parking Overlay (Schedule 1) and Design and Development Overlay (Schedule 16), to remove the land from Deepdene Neighbourhood Centre - Area 1.
  • Rezone part of 1-2/26 Whitehorse Road, Deepdene from Neighbourhood Residential Zone (Schedule 3) to Commercial 1 Zone and apply Parking Overlay (Schedule 1) and Environmental Audit Overlay.

Glen Iris

  • Rezone part of 2A High Street, Glen Iris from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone parts of 28B Prosper Parade and 46 Audrey Crescent, Glen Iris from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone part of 90 Summerhill Road, Glen Iris from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone. 

Hawthorn

  • Rezone part of 63-65 Church Street, Hawthorn from Commercial 1 Zone to Public Park and Recreation Zone and delete Design and Development Overlay (Schedule 16) and Parking Overlay (Schedule 1), to remove the land from Church Street Neighbourhood Centre - Area 2.
  • Rezone parts of 458 Glenferrie Road, Hawthorn to Public Park and Recreation Zone.
  • Rezones part of Reserve Road, near the intersection of Kooyongkoot Road, from Public Park and Recreation Zone to Neighbourhood Residential Zone Schedule 3.
  • Rezone part of 3 Scotsburn Street, Hawthorn from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone part of 2 Wallen Road, Hawthorn from Neighbourhood Residential Zone Schedule 3 to Public Park and Recreation Zone and correct the boundaries of Heritage Overlay (Schedule 148).

Hawthorn East

  • Rezone 96A Camberwell Road, Hawthorn East to Public Park and Recreation Zone and delete Design and Development Overlay (Schedule 17) and Parking Overlay (Schedule 1), to remove the land from Burwood/Camberwell Road Commercial Corridor - Area 1.
  • Rezone part of 18 Symonds Street, Hawthorn East from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.
  • Rezone 502 Tooronga Road, Hawthorn East from Commercial 1 Zone to Neighbourhood Residential Zone (Schedule 3).

Kew

  • Rezone parts of 105-109 Normanby Road, Kew from Neighbourhood Residential Zone (Schedule 3) to Public Park and Recreation Zone.

Surrey Hills

  • Apply Parking Overlay (Schedule 1) and Design and Development Overlay (Schedule 16) to 111-113 Union Road, Surrey Hills, to include the land in Surrey Hills Neighbourhood Centre - Area 2.
