About Heritage Overlay Anomalies and re-gradings

This project proposes to correct a number of Heritage Overlay anomalies contained within the Boroondara Planning Scheme which include rectifying mapping errors and updating the heritage grading (non-contributory, contributory and individually significant) to 32 properties already included in the existing Heritage Overlay.

On 20 August 2018, the Urban Planning Special Committee (UPSC) resolved to undertake two planning scheme amendments (C302 and C303) to correct a number of anomalies in the Boroondara Planning Scheme.

The UPSC also resolved to adopt the heritage re-gradings to properties in the existing Heritage Overlay.

The heritage re-gradings do not require a planning scheme amendment as it is simply an administrative update based on an adopted position of the UPSC.

Current status (August 2018)

Amendment C302

The corrections which are an obvious or technical error in the Boroondara Planning Scheme can be fast-tracked through Section 20A of the Planning and Environment Act 1987.

In accordance with the UPSC resolution, officers have lodged a fast-track planning scheme amendment with the Minister for Planning.

In accordance with the resolution, Council has submitted Amendment C302 to the Minister for Planning for approval. Council is now awaiting the Minister’s decision. Once the Minister for Planning has made a decision on Council’s request for approval, Council will notify all affected and relevant adjoining property owners and occupiers of the Minister’s decision.

Amendment C303 

The corrections which are not an obvious or technical error in the Boroondara Planning Scheme require full notice to be given under sections 17, 18 and 19 of the Planning and Environment Act 1987.

Council has requested authorisation from the Minister for Planning to prepare and exhibit Amendment C303. Following authorisation from the Minister for Planning, Council will commence the exhibition process. 

As part of the public exhibition process, we will notify and invite feedback from:

  • All affected and adjoining property owners and occupiers
  • Anyone who lodged feedback as part of the preliminary consultation; and
  • Interested stakeholders.
