In response to community requests, Council engaged heritage consultants Context Pty Ltd to undertake a heritage assessment of 1207 Burke Road, Kew. 

Context Pty Ltd concluded that 1207 Burke Road, Kew is of local historical (associative) significance to the City of Boroondara (Criterion H) for its association with B.A. Santamaria, and recommended that 1207 Burke Road, Kew be included in the Heritage Overlay as an individually significant heritage place. 

B.A Santamaria was a prominent figure in the Catholic Church and Australian public life through much of the twentieth century. He resided at the residence from 1960 to 1983 and wrote several of his major works in the library of the house and memorised his speeches by walking up and down the driveway. Much of the wider work that Santamaria was involved in, through the Catholic Church, was centred around the suburb of Kew, where he resided.

Current status - March 2021

On 22 March 2021, Council’s Urban Planning Delegated Committee (UPDC) considered the feedback received during preliminary consultation on the draft heritage citation for 1207 Burke Road, Kew.

At the meeting the UPDC resolved to:

  • adopt the heritage citation for 1207 Burke Road, Kew; and
  • proceed with a planning scheme amendment to include the property in the Heritage Overlay on a permanent basis.

In accordance with the UPDC resolution, Council officers wrote to the Minister for Planning on 30 March 2021 to request authorisation to prepare and exhibit Amendment C352 to the Boroondara Planning Scheme. The amendment proposes to include 1207 Burke Road, Kew in the Heritage Overlay on a permanent basis. Council is awaiting the Ministers decision.  

Next steps

Once authorisation to prepare the amendment is received from the Department of Environment, Land Water and Planning, officers will prepare and commence public exhibition of the amendment. Council cannot commence the planning scheme amendment process until authorisation has been received.

Affected and adjoining property owners/occupiers and anyone who made a submission during preliminary consultation will be notified at the start of the exhibition period.

Interim Heritage Overlay request 

Council has requested interim heritage protection for 1207 Burke Road, Kew from the Minister for Planning while Council progress the amendment for a permanent Heritage Overlay for the property. Council is awaiting the Minister’s decision.
