Boroondara City Council (Council) gives notice under section 190 of the Local Government Act 1989 (the Act) of its intention to vary and extend the lease for shop 9 and shop 16, 519-525 Riversdale Road, Camberwell, both being land contained in certificate of title volume 7862 folio 027 (Premises).

The principal terms of the lease will be:

Shop 9

  1. Tenant: CMMM Pty Ltd as Trustee for the Dixon Trust.
  2. One (1) additional further term option of three (3) years.
  3. Market rental.
  4. Rent to be reviewed annually by fixed increases of four (4) percent and a market review upon the exercise of each option.
  5. Outgoings and other charges are payable by the tenant.
  6. The permitted use is ‘retail sale of poultry, eggs, goat, venison, buffalo, camel, hare, rabbits, crocodile, wild boar, beef, lamb and other such items as authorised by the council in writing from time to time’. 

Shop 16

  1. Tenant: CP Daniell Pty Ltd.
  2. One (1) additional further term option of five (5) years.
  3. Market rental.
  4. Rent to be reviewed annually by fixed increases of four (4) percent and a market review upon the exercise of each option.
  5. Outgoings and other charges are payable by the tenant.
  6. The permitted use is ‘retail sale of fresh seafood and such other items as authorised in writing by Council from time to time’. 

In accordance with section 223 of the Act, any person wishing to make a submission must do so in writing no later than Friday, 5 February 2021.

All submissions will be considered in accordance with section 223 of the Act.

A person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of the Council or its Committee on a date, time and place to be determined by the Council.

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.
