Boroondara City Council (Council) gives notice under section 190 of the Local Government Act 1989 (“the Act”) of its intention to enter into a lease with the following ten facilities within the Boroondara municipality.

1. Access Health and Community - Part of Hawthorn Art Centre, 360 Burwood Road, Hawthorn 3122

The principal terms of the lease will be:

(i) A term of four (4) years.
(ii) Annual rental is commencing at $40,679.86 plus GST and will be increased annually by CPI.
(iii) Outgoings and other charges are payable by the tenant.
(iv) The permitted use is ‘Provision of early intervention, care and services (focused on mental health and vocational support) for young people aged from 12 to 25 years operating as headspace Hawthorn, and associated purposes as agreed by Council’.

The principal terms of the leases 2 to 6 will be:

(i) A term of five (5) years.
(ii) Peppercorn rental.
(iii) Outgoings and other charges are payable by the tenant.
(iv) The permitted use is ‘Kindergarten and ancillary purposes as agreed by Council’.

2. Auburn South Pre-School Inc - 5 Anderson Road, Hawthorn East 3123

3. Bellevue Kindergarten Association Inc - 49 Bulleen Road, Balwyn North 3104

4. Early Childhood Management Services Inc - 92 Maud Street, Balwyn North 3104

5. Rowen Street Kindergarten Inc - 27 Rowen Street, Glen Iris 3146

6. Surrey Hills Pre-School Centre Inc - 18 Verdun Street, Surrey Hills 3127

The principal terms of the leases 7 and 8 will be:

(i) A term of five (5) years.
(ii) Peppercorn rental.
(iii) Outgoings and other charges are payable by the tenant.
(iv) The permitted use is ‘Kindergarten, child care programs, associated purposes and any further purposes as agreed by Council’.

7. West Hawthorn Pre-School Centre Inc - 39 Brook Street, Hawthorn 3122

8. Auburn Kindergarten & Child Care Centre Inc - 27 Station Street, Hawthorn East 3123

9. Kew Full Day Care Inc - 3 Belford Road, Kew 3101

The principal terms of the lease will be:

(i) A term of five (5) years.
(ii) Peppercorn rental.
(iii) Outgoings and other charges are payable by the tenant.
(iv) The permitted use is ‘Long day care for children aged 0-6 years and associated purposes as agreed by Council’.

10. South Hawthorn Tennis Club Inc - 3 and 11 Anderson Road, Hawthorn East 3123

The principal terms of the lease will be:

(i) A term of five (5) years.
(ii) Annual rental is commencing at $107.99 inclusive of GST and will be increased annually by CPI.
(iii) Outgoings and other charges are payable by the tenant.
(iv) The permitted use is ‘For the purpose of tennis club and associated community activities. This excludes commercial ventures, except where authorised by Council’.

Making a submission

In accordance with section 223 of the Act, any person wishing to make a submission must do so in writing no later than Wednesday, 5 August 2020.

All submissions will be considered in accordance with section 223 of the Act.
A person making a submission is entitled to request in the submission that they wish to appear in person, or to be represented by a person specified in the submission, in support of the submission at a meeting of the Council or its Committee on a date, time and place to be determined by the Council.

Any person making a written submission under section 223 of the Act is advised that all submissions and personal information in the submission will be handled by Council in accordance with the provisions of the Privacy and Data Protection Act 2014.
