Two new townhouses at 42 Normanby Road, Kew, have been demolished because they did not comply with Council’s planning permit.
The builder, Mr Nicholas Pantas, made major changes to the dwellings, including constructing the dwellings above mandatory height controls, without seeking permission from Council.
Council successfully obtained an Enforcement Order from the Victorian Civil and Administrative Tribunal to demolish the townhouses. Council also successfully prosecuted Mr Pantas in the Magistrates Court and he was ordered to pay $8000 in penalties and costs.
Quotes attributable to Cr Phillip Healey, Mayor of Boroondara
“The builder’s action was downright illegal. Council will take enforcement action against those who ignore the law.”
“This is a costly reminder that planning permits and approved plans must be complied with. Changes cannot be made without firstly seeking permission from Council.”
