Cake stall, barbecue, sausage sizzle, street stall, and footpath sale permit
A permit is required by anyone wanting to use roads, footpaths and other public spaces for fundraising activities including:
- cake stalls
- barbecues
- sausage sizzles
- street stalls
- footpath sales.
Please note: running such activities on a road, footpath or other public space without a permit is subject to a penalty.
An application fee of $64 applies (registered charities and non-profit organisations are exempt) and five working days notice is required for Council to process your application.
Guidelines and conditions
- A person must not, whether or not in the company of others, hold a cake stall, street stall, footpath sale, barbecue or sausage sizzle on any footpath, nature strip, public car park or other part of the road or Council land without a permit.
Penalties apply. - A direction by members of the Victoria Police or authorised officer of Council must be complied with at all times.
- If any food is to be sold, application for Temporary Registration under the Food Act 1958 approved by Council's Health Services Department must be obtained: phone (03) 9278 4701.
- All barbecues/cake stalls must be located in the Trading zone and must be placed at a 90-degree angle to the kerb. This will allow customers to stand in front of and queue along the footway in the Trading zone, leaving the Pedestrian zone clear for pedestrians to walk past.
- Customers must not be served on the side of the barbecue/cake/street stall facing the Pedestrian zone.
- The structure, screen and any staff cooking/serving must stay within the Trading zone.
- Cardboard, or associated material, must be placed on the footway to absorb any food or other spillages.
- Any stall-holder selling home-made cakes and the like, are required to be at least 30 metres from any cake or pastry shop.
- No nuisance shall be committed.
- There shall be no undue obstruction to pedestrian or vehicular traffic; entrances to shops and buildings shall be kept clear at all times.
- Approval of the business in front of whose premises you wish to operate must be obtained.
- The permit:
- is valid for the date of issue only
- is not transferable
- may be cancelled by Council at any time and for any reason.
A copy of this permit must be carried at all times during events.
Non-compliance with the provision of the permit may result in the cancellation of this permit and the application of penalties.
Ensure you include:
- a valid certificate of Public Liability Insurance up to $10 million
- application fee of $64 (registered charities/non-profit organisations are exempt).
