Temporary and mobile food premises permits

As of 1 July 2010 there is a new food classification system which also applies to community groups as well as food businesses. The scheme will make it easier for food businesses and community groups that currently require multiple registrations to operate in different council districts.

Depending on your food handling activities, if you operate a food stall or food van you will need to register (class 2 and 3) with, or notify (class 4), the one council which is known as your Principal Council.

 

What are temporary or mobile food premises?

Temporary food premises are temporary stalls or tents from which food is sold, such as a market or festival. It can be any structure that is not permanently fixed to a site.

Mobile food premises are vehicles such as vans, trailers or carts from which food is sold.

Statement of Trade

Once a temporary /mobile food business is registered with the principal council a statement of trade is required to be lodged with the council in Victoria in whose district they trade.


Class 2:

Premises selling high risk unpackaged food where the food is cooked and then stored under refrigeration and reheated or stored hot in a bain marie. For example rice or curries.

Class 2 applicants must have a Food Safety Program. A Food Safety Supervisor is not required by a community group if:

  • the majority of persons involved in the handling of the food are volunteers; and
  • the activity takes place at the premises for a maximum of two consecutive days at any one time.

Class 3:

 

Premises handling high risk pre-packaged food and low risk unpackaged food. For example, a barbeque involving hamburgers or other meat, or eggs and bacon which are all cooked and served immediately - 'cook and serve'.

 

Class 3 applicants must maintain minimum records at their event. Further information about the new minimum records is available below.

Class 4:

  • sausage sizzles with bread, onion, and sauce (no cheese or other foods)
  • selling packaged cakes (no cream)
  • wine tasting (can include low risk food or cheese).

Class 4 applicants do not need to register as a food premises but you do need to notify Council.
